SNP Schlawien Assists BioEnergie Taufkirchen in Sale to Stadtwerke München
The commercial law firm SNP Schlawien assisted BioEnergie Taufkirchen GmbH & Co. KG (BET) in its sale to Stadtwerke München (SWM / Munich public utility company). The acquisition is made subject to the condition precedent of the consent by the Federal Cartel Office (Bundeskartellamt); they agreed not to disclose the purchase price. The consulting by SNP Schlawien encompassed all legal issues relating to the structuring of the transaction.
BioEnergie Taufkirchen was formed in 1999 and operates a biomass heating plant fired with wood generating some 25,000 MWh of green electricity per year, which is enough to supply about 10,000 households, as well as circa 150,000 MWh of eco-heat. In addition to private households, key accounts such as the University of the Bundeswehr (German armed forces), EADS, wholesale markets, real estate companies such as IVG or GEWOFAG, and the municipality of Taufkirchen are among the major customers. The associated district heating grid of about 43 kilometers in length supplies eco-heat to parts of the municipalities of Taufkirchen, Ottobrunn and Neubiberg. BET has 16 employees on its payroll who are going to continue operating the plant also under SWM.
By way of the acquisition of BioEnergie Taufkirchen, Stadtwerke München take another step toward carbon-neutral energy supply, thus approaching their goal: Within the framework of the SWM Renewable Energies Expansion Initiative, Munich is supposed to become the first major German city where 100% of the district heating is generated from renewable energies by 2040. Two years ago, Stadtwerke München purchased the geothermal power stations in Dürrnhaar and in Kirchstockach already.
